Amanda Mogan Photographers: Terms and Conditions
Definitions
“Photographer” refers to Amanda Morgan Photographers.
“Client” refers to the individual or individuals who have contracted the services of the Photographer.
“Event” refers to the wedding or event for which photography services are booked.
“Agreement” refers to the contract formed by these terms and conditions, the booking form, and any other written agreements between the Photographer and the Client.
Booking and Payments
A non-refundable booking fee of 25% of the total package price is required to secure the date.
The remaining balance is due 30 days before the Event.
Payments can be made via bank transfer, credit card, or other agreed methods.
Cancellation Policy
If the Client cancels the booking more than 90 days before the Event, no further payment is required.
If the Client cancels the booking less than 90 days before the Event, the Client is responsible for paying 50% of the remaining balance.
If the Photographer cancels, all payments including the booking fee will be refunded, and the Photographer will assist in finding a replacement photographer.
Change of Date
The Client must notify the Photographer of any changes to the Event date as soon as possible.
The Photographer will attempt to accommodate the new date but cannot guarantee availability. If the Photographer is unavailable on the new date, the booking will be treated as a cancellation.
Photographic Materials
The Photographer retains the copyright to all photographs.
The Client is granted a license for personal use of the images. Commercial use is prohibited unless explicitly agreed in writing.
Image Delivery
The Photographer will deliver edited images within 6-8 weeks after the Event.
The images will be delivered digitally via a secure online gallery.
Physical prints and albums are available at additional cost as per the pricing on the Photographer’s website.
Client Responsibilities
The Client is responsible for ensuring the Photographer has access to the Event location and any necessary permissions for photography.
The Client agrees to provide a meal for the Photographer if the coverage exceeds 5 hours.
Photographer’s Responsibilities
The Photographer will use professional equipment and techniques to ensure high-quality images.
The Photographer will make every effort to capture key moments but cannot guarantee specific shots due to the dynamic nature of events.
Limitation of Liability
The Photographer’s liability for any claims, costs, damages, or losses arising from the services is limited to the amount paid by the Client.
The Photographer is not responsible for any force majeure events that prevent the fulfilment of this Agreement.
Privacy and Data Protection
The Photographer will collect and process personal data in accordance with the UK General Data Protection Regulation (GDPR).
The Client’s personal information will not be shared with third parties without consent.
Model Release
The Client grants the Photographer the right to use images for promotional purposes, including on the Photographer’s website and social media, unless the Client requests otherwise in writing.
Dispute Resolution
Any disputes arising from this Agreement will be resolved through negotiation in good faith.
If negotiation fails, the dispute will be referred to mediation before pursuing litigation.
Governing Law
This Agreement is governed by and construed in accordance with the laws of England and Wales.
Any legal actions or proceedings arising from this Agreement will be brought exclusively in the courts of England and Wales.
Miscellaneous
Amendments to this Agreement must be made in writing and signed by both parties.
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
